Privacy Policy

The purpose of this privacy policy (“Privacy Policy”) is to set out how Funds Flow (referred to as “Funds Flow”, “we,” “us,” and/or “our”) collects, processes, stores, shares and uses any Personal Data or Information (as defined below) it collects from the Users of the Platform which can be found on the following link: https://funds-flow.com [MA1]  (“Platform”). Such Users shall individually be referred to as (“You”, “Your”, “User”, and/or “Customer”) and collectively as (“Users”, “They”) when You access, use and/or register, Our Platform.

Please read attentively this Privacy Policy as well as the relevant Terms & Conditions before proceeding to register, apply for and/or request or use our services (“Services”).

Funds Flow shall not be held liable, under any circumstances, for any negligence or failure by a User as a result of not reading the Privacy Policy before using the Services or the Platform. For the avoidance of doubt, you agree that accessing or using the Services, or the Platform is by itself deemed an acknowledgment of having read and accepted the Privacy Policy, as amended from time to time.

1.    COLLECTION OF PERSONAL DATA/ INFORMATION THAT WE COLLECT

We may collect and use information about you where it is necessary for our variety of purposes. We collect non-personally identifiable information of our Users (A) as well as personally identifiable information (B) (Both referred to as “Personal Data” or “Data”).

The Data we may collect from Users includes:

(A)Non-personally Identifiable Information

Funds Flow collects non-personally identifiable information of Users visiting its Platform , whether a registered User or not, which includes without limitation; the browser type, language preference, referring site, the date and time of each User’s request, the pages a User has viewed directly before and/or after accessing our Platform and other interactions with it and other Users via server log files, as well as any other information a User chooses to provide us with.

(B) Personally Identifiable Information

We collect various types of Personally Identifiable Information (“PII”) from Users in connection with their use of the Service and the Platform.

For the purposes of this Privacy Policy, PII includes any information relating to an identified or identifiable natural person. This includes data that directly or indirectly identifies a User, such as a name, identification number, online identifier, or any other information that can be reasonably linked to an individual for the purpose of accessing or using the Service or the Platform.

The PII we collect from Users may include, but is not limited to, the following:

·        First and last name (for natural persons) or company name (for juristic persons);

·        A valid and active mobile phone number;

·        A valid and active email address;

·        Geographic location and area of residence or operation;

·        Encrypted account password stored securely by Funds Flow.

 

2.    PURPOSE FOR COLLECTING AND PROCESSING YOUR DATA

We collect and retain your information for the following purposes:

•   To enhance the safety and security of our Users and Services (i.e., verify the identify and eligibility to perform the relevant Services);

•   For Customer’s technical support and feedback;

•   To notify you of any changes to our Services, Terms & Conditions and/or, Privacy Policy;

•   To send you marketing and non-marketing communications;

•   To use in any relevant legal proceedings (if any);

•   To provide our Users with a personalized and improved use of our Services;

•   To manage your Account, manage your registration as a User. The Personal Data you provide can give you access to different functionalities of the Service that are available to you as a registered User.

•   Perform necessary analysis and operations to maintain our Services, such as fixing bugs and/or, operational problems.

•   To contact you by email, or other equivalent Electronic Means of Communications (as elaborated in the Terms & Conditions) regarding updates or informative communications related to the functionalities,  or contracted Services, including the security updates, when necessary or reasonable for their implementation.

•   In the event that Funds Flow undergoes or considers a merger, acquisition, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of its assets—whether as a going concern or as part of bankruptcy, insolvency, or similar proceedings— and Personal Data held about our Users may be among the assets transferred or disclosed as part of the due diligence process. Any such transfer will be subject to appropriate safeguards to ensure the continued protection of your Personal Data in accordance with applicable data protection laws and this Privacy Policy.

 

3.    DATA PROTECTION

Funds Flow are committed to safeguarding the privacy and security of your Personal Data. As the data controller, we determine how your Personal Data is collected, used, and retained, and we take this responsibility seriously.

We process your Personal Data in accordance with applicable data protection laws and principles, ensuring that your information is:

·       Collected and processed lawfully, fairly, and transparently;

·       Used solely for specific, explicit, and legitimate purposes that we have communicated to you;

·       Relevant, adequate, and limited to what is necessary in relation to those purposes;

·       Accurate and kept up to date;

·       Retained only for as long as necessary to fulfill the purposes for which it was collected;

·       Stored and handled securely using appropriate technical and organizational measures.

To protect your Personal Data, Funds Flow implements robust security practices, including encryption technologies and secure storage protocols.

All our personnel receive mandatory data protection training to ensure compliance with internal standards and applicable legal requirements.

While we take all reasonable precautions to secure your data, no internet-based platform can be entirely immune to risks. By using the Platform, you acknowledge the inherent risks of transmitting data online and agree that Funds Flow shall not be held liable for any unauthorized access or security breach unless resulting from our gross negligence or willful misconduct.

4.    PERSONAL DATA RETENTION

Funds Flow will retain your Data only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use your Personal Data to the extent necessary to comply with our legal obligations. For instance, if we are required to retain your Data to comply with applicable laws, resolve disputes, and enforce our legal agreements and policies.

Funds Flow will also retain usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period of time, except when these Data are used to strengthen the security or to improve the functionality of our Service, or we are legally obligated to retain these Data for longer time periods.

Please note that in some circumstances, we may be legally required to retain your Personal Data even after the deletion of your account on the Platform.

5.    TRANSFER OF PERSONAL DATA

Your Personal Data is processed at Funds Flow's operating offices and in any other places where the parties involved in the processing are located. It means that this information may be transferred to — and maintained on — computers located outside of your state, province, country or other governmental jurisdiction where the data protection laws may differ than those from your jurisdiction.

6.    SENSITIVE INFORMATION

We neither collect nor store any sensitive Personal Data regarding our Users, which include Personal Data that pertain to their psychological, medical, physical or genetic state, biometric data, religious beliefs, political opinions, financial status and security status.

In all cases, Data relating to children (under the age of 18) are considered sensitive data. Disclosing sensitive data without observance of the applicable law requirements would be exposed to legal consequences.

Consequently, you shall be liable for disclosing any sensitive data to Funds Flow, and Funds Flow shall not assume or be held liable for any sensitive data disclosed or submitted from your side, whether voluntarily or not. Funds Flow reserves the right to remove and destroy any Data that is deemed sensitive and provided in breach of the applicable law.

7.    PRIVACY POLICY FOR CHILDREN

Our Services does not address anyone under the age of eighteen (18). Please note that Funds Flow does not knowingly collect, keep, maintain or use any children’s Personal Data. Funds Flow shall thus not be held liable for any children’s Data you willingly provide us with.

If you are a parent or guardian and you are aware that your child has provided us with Personal Data, please contact us.

8.    SECURITY

We have implemented reasonable technical, physical and administrative safeguards to help protect your Personal Data from unlawful use and/or, unauthorized disclosures.

Access to your Personal Data is limited to our workers, service providers, auditors, successors that must necessarily access it and that are bound by a contractual confidentiality obligation with us or by the law.

While Funds Flow has taken reasonable steps to secure the Personal Data you provide, please be aware that despite our efforts, no security measures are perfect or impenetrable, and no method of Data transmission can be guaranteed against any interception or other type of misuse. 

Any information disclosed online is vulnerable to interception and misuse by unauthorized parties. Therefore, we cannot guarantee complete security if you provide Personal Data.

9.    DISCLOSING YOUR PERSONAL DATA (LEGAL REASONS CONSENT)

Funds Flow may disclose your Personal Data in limited circumstances, strictly in accordance with applicable laws and only when necessary for legal or operational reasons, or with your explicit consent.

A. Legal Obligations and Necessity

Funds Flow may disclose your Personal Data when we believe, in good faith, that such disclosure is required to comply with applicable laws, regulations, court orders, operating licenses, or any other legal or regulatory obligations. This includes responding to lawful requests from government authorities or regulatory bodies.

Additionally, Funds Flow may share your Personal Data with third parties where necessary for Platform functionality or Service provision under contractual obligations.

B. With Your Consent

In situations not covered by the above, Funds Flow may request your explicit consent to share your Personal Data with third parties. Such disclosures will only occur with your prior approval. You reserve the right to decline such requests. However, please note that refusal to grant consent may limit your access to certain features or services on the Platform where such sharing is essential for functionality or compliance.

10.   THIRD PARTIES

Funds Flow recourses to third-party services in our relationship with you, such as including payment gateway links. Your Personal Data is thus disclosed to these third parties whenever necessary. In that regard, the usage, storing, disclosing, processing or retaining of your Data shall be subject to the privacy policies of the relevant third-parties.

Payments processed via our Platform by third-parties payment processors are not accessible nor controlled by Funds Flow that shall not be held liable for any failure of any third-party’s service providing or Data privacy regulation.

Our Platform may contain links to other websites that are not operated by us. If you click on a third-party link, you will be directed to that third party's site. We strongly advise you to review the privacy policy of every site you visit. We have no control over and assume no responsibility for the content, privacy policies or practices of any third-party sites or services.

 

 

11.  USER’S RIGHTS

You shall have the right to modify, delete and/or, add any Personal Data as you wish for your account with the aim of keeping all Data accurate and up to date. Users shall undertake the responsibility to modify their information and Data on their account’s profile on our Platform.

Funds Flow shall comply with all applicable data protection laws and regulations in our relationship.

If you wish to object to direct marketing please notify us using the contact details below or, in the case of emails, if you are a User of the Platform, you can also use the ‘unsubscribe’ feature which you can find on our emails. To ensure that we respect your request we may retain your contact details on a suppression list.[Dm2] 

12.  BUSINESS TRANSFER

Please note that as your Personal Data constitutes one of Funds Flow’s assets, in the event where Funds Flow, or substantially all of its assets, were acquired, or goes out of business or enters bankruptcy, your information shall be transferred or acquired by a third party.

You acknowledge that such transfers may occur, and that any acquirer of Funds Flow may continue to use your Personal Data as set forth in this Privacy Policy.

13.  MODIFICATIONS

We reserve the right to modify this Privacy Policy at any given time for any given reason (i.e., to comply with new laws and regulations and/or include any new activity or Services for Funds Flow).

In all cases, updates shall be specified through the “Last updated” date added to this Privacy Policy and which will be available on the Website.

Therefore, please make sure to read and review the latest updates to the Privacy Policy enacting the amendment from time to time.

For the avoidance of doubt, Funds Flow shall not be held liable for any negligence or failure of a User to read or review the updates to the Privacy Policy before accessing or using the Platform or the Services.

Your use of and/or access to our Platform after such modification constitutes by itself your consent to be bound by the last updated version.

14.  ACCOUNT PREFERENCES

You may make changes to your  account and any associated preferences at any time. To make changes, you must log onto the Platform and make any edits through the My Account section[Dm3] . You may terminate your account.

15.  PROFILE

Upon registration, Users on Funds Flow will be prompted to create a profile. This profile may include, but is not limited to, your name, professional background, personal statement, work experience, objectives, and information typically found in a résumé. Users may update or modify their profile information at any time through their account dashboard.

Profiles are only accessible to other Users who are subscribed to a paid package.

We encourage you to exercise discretion and good judgment when completing your profile, as certain information may be visible to other authorized Users on the Platform. Your profile is a key component of how you present yourself to potential partners, investors, or collaborators within Funds Flow community.

16.  INTERNET

As part of our commitment to improving the User’s experience on the Platform, we collect certain technical and usage-related information when you interact with our website. This includes data such as the web address (URL) of the site you visited immediately before and after accessing Funds Flow, as well as your device’s unique IP address and browser type.

We also use standard tracking technologies, including cookies and server logs, to analyze usage trends, manage the platform, and enhance the functionality and personalization of our services. Cookies are small data files stored on your device that help us remember your preferences and settings for future visits. They are safe, do not harm your device, and can be deleted or managed through your browser settings at any time.

Cookies do not access data from your device's hard drive, nor do they retrieve Personal Data such as email addresses or other identifiers unless you have voluntarily provided that information.

Most web browsers are configured to accept cookies by default, but you can choose to disable or limit the use of cookies through your browser settings. Please note that restricting cookies may affect the functionality and usability of certain features on the Platform.

17.  SYSTEM EMAILS

As part of the normal operation of the Platform, you will receive email communications related to your activity on the site. These may include transactional messages, system notifications, and important updates regarding your account. We strive to keep these communications relevant and to a minimum.

In addition, Funds Flow may send you system-generated messages and promotional materials, including platform updates, service announcements, and offers that may be of interest. These communications may begin during the registration process and will continue for as long as your account remains active. You may manage your communication preferences or opt out of promotional emails at any time through your account settings.

 

18.  APPLICABLE LAW AND JURISDICTION

You hereby agree to try and settle any disputes, differences and/or claims arising out of the terms of this Privacy Policy informally and amicably with Us.

In the event where we fail to reach an amicable settlement within a minimum period of thirty (30) days, all disputes, differences and /or claims arising out of the terms of this Privacy Policy shall be settled by arbitration in accordance with the arbitration rules of the Cairo Regional Center for International Commercial Arbitration (“CRCICA”). The place of arbitration shall be in the Arab Republic of Egypt. The language of arbitration shall be English and the arbitration shall be conducted by a sole arbitrator.

This Agreement and any other agreements You may have with the Company shall be subject to the laws of the Arab Republic of Egypt, in particular the Data Protection Law No.151 of 2020.
